There are very few exceptions (i.e. active military service) where a tenant can simply terminate the lease and then abandon the property. In other words, the type of lease is such that a lessor must receive a set amount of money during the term of the lease. Similarly, a landlord must not simply terminate the contract and remove the tenant prematurely. He or she should go through a lengthy process involving a court-ordered deportation. As a general rule, an owner would need a very good reason and proof of an offence to achieve this goal. In this type of agreement, laws have been passed by local, government and federal governments to protect the rights of those who act as landlords and tenants. All states, including Georgia, are mandated by federal law to include certain indications in their leases. For example, all leases and leases should be included: the lessor would lose all deposit rights if the money was not initially deposited into a trust account. Or if the owner does not provide entry or exit inspection lists.
Any lessor who intentionally and unfairly withheld deposits may be held responsible for three times the total amount withheld, plus legal fees. An owner must indicate in writing whether the premises have been damaged three or more times by flooding in the past five years. (O.C.G.A. 44-7-20) This is a good example of the provisions that a simple lease could contain and the form that should be taken in its final form.
